Ashley St. Clair has filed a lawsuit against Elon Musk, seeking sole legal custody of their son, born in September 2024.
In the petition, St. Clair claims that Musk has had little involvement in the child’s life, having only met him three times, the last visit taking place in November 2024.
St. Clair’s filing, submitted to the New York Supreme Court on February 21, 2025, includes a request for the court to declare Musk as the child’s father and address related custody and support matters.
The petition asserts that New York is the child’s home state, and St. Clair is seeking to ensure his well-being and best interests are protected.
Musk’s Limited Involvement
The legal documents state that Musk did not attend the child’s birth and had minimal interactions with the infant.
St. Clair mentions that after sending Musk a photo of their newborn, Musk expressed interest in meeting the child but did not establish a consistent presence in his life. The last meeting between Musk and R.S.C. occurred on November 30, 2024, lasting just 30 minutes.
St. Clair has also filed a paternity petition, reaffirming Musk’s acknowledgment of parentage through written communications, including a text exchange where Musk allegedly expressed eagerness to meet the child.
A History of Attempted Private Resolution
According to St. Clair’s attorney, Karen B. Rosenthal, attempts were made to resolve the custody and support issues privately through communication with Musk’s legal team. However, these efforts reportedly fell through, prompting St. Clair to file for a court resolution.
Rosenthal further noted that Musk’s legal representatives have been nonresponsive, leaving St. Clair with no choice but to move forward with the petition. St. Clair’s legal team is requesting that the court issue an order for Musk to provide evidence on the custody and support issues.
Musk’s Past Relationships and Family Dynamics
This lawsuit comes on the heels of another public issue involving Musk’s family life. His former partner, Grimes, the mother of three of Musk’s children, took to social media recently, pleading for Musk’s attention to a “medical crisis” involving one of their children.
Musk’s complex family dynamic includes 13 children with multiple women, and this legal case adds another layer to his already high-profile personal life.
As the custody battle unfolds, the focus remains on ensuring the child’s best interests are protected and whether Musk will respond to St. Clair’s legal actions.
