A Brazilian judge has ordered Adele’s 2015 song “Million Years Ago” to be removed from all radio and streaming platforms worldwide.
The decision comes after singer-songwriter Toninho Geraes claimed the track plagiarized his 1996 song “Mulheres,” performed by Martinho da Vila.
Court Ruling Details
Judge Victor Torres, in Rio de Janeiro, issued a preliminary injunction directing Sony Music Entertainment and Universal Music to stop distributing the song immediately. This includes all physical and digital formats, as well as streaming and sharing platforms. Non-compliance could result in fines of $8,000 per violation.
The plagiarism case, initially filed in 2021, marks a significant legal win for Geraes. His lawyer, Fredimio Trotta, called the decision a “landmark for Brazilian music,” emphasizing its importance in protecting local artists from international misuse.
Geraes’ Claims and Demands
Geraes is seeking lost royalties, $160,000 in damages, and a songwriting credit for the track. He described the ruling as a step toward preventing “parasitic use” of Brazilian music.
Previous Accusations
This isn’t the first plagiarism claim against “Million Years Ago.” Fans in Turkey previously accused the song of copying the 1985 track “Acilara Tutunmak” by Kurdish singer Ahmet Kaya.
Industry Impact
The case highlights ongoing issues of copyright in the music industry, particularly concerning lesser-known international artists. For Adele, this ruling adds a new chapter to her career, as her representatives and labels have yet to comment on the matter.
